Terms and Conditions

Thank you for choosing Diaz Designs.

Please read these terms carefully. If you do not accept the Terms and Conditions stated below, you may not use Diaz Designs services.

1. Payment Policy
Diaz Designs implements a company policy of only starting work on a project after receiving full-payment. This is not negotiable. The grant of any license or right of copyright is conditioned on receipt of full payment.

2. Default in Payment
The Client shall assume responsibility for all legal fees amassed by Diaz Designs following default in payment.

3. Refund & Cancellation
Client can only receive a refund if cancellation occurs before delivery of first initial design ideas, and there will be a $45.00 administration fee for all refunds. In the event of Client cancellation of a project that has already been in design delivery phases, a fee for work already completed, based on an hourly rate shall also be paid by Client, and the ownership and copyright of all design, copy and artwork shall be retained by Diaz Designs.

4. Revisions
Our design packages do not provide clients with unlimited design revisions. The set design fee includes a specified number of revisions. Any other changes that the Client wishes to make, that are not due to designer error, will be billed an additional hourly rate.
Diaz Designs is also not responsible for any typos or misspellings in the Client's project(s). The Client takes full responsibility for submitting finalized copy writing, text and/or headlines.

5. Project Duration
Clause A: Ability to meet deadlines is dependent on the Client’s provision of all necessary information and approval in a timely manner. The Client agrees that it shall not hold Diaz Designs liable for any incidental or consequential damages that arise from a failure to complete the project by a specified target date. Diaz Designs' 3-day service applies to Packages only and requires 3 business—days to complete - e.g. An order placed on Friday afternoon will not be completed until Wednesday afternoon — weekends will not be classed as business days. This 3-day time frame is dependent on the Client’s payment. Project time will not be ”clocked” until confirmation of Client’s payment. Hourly rates are also dependent on the Client's responsibility to provide information and respond in a timely manner. These concept deliverables vary and may be delivered within 1-3 business days, provided the client submits their information.
Clause B: If the Client chooses to purchase the Logo Design Package, alongside a Business Card Package, the designer and Client are entitled to use the first 3 business days to finalize the Logo, and then the respective additional days and revisions will apply for any other following packages and hence forth. For this reason, a business card, letterhead, etc cannot be created without the finalization of a final company logo, unless the logo is provided.
Clause C: Only one Client/ Liaison should be in contact with the designated Graphic Designer. If in an event your designer is unable to continue your project, he or she may transfer your project to another Designer in order to complete the project in the agreed timely manner.

6. Print Duration
Print services are not included in the design time line. If the Client chooses to use our printing services then the there will be a 1-2 week turnaround period, following completion of the initial design service. All print services require full-payment before Diaz Designs can begin the print process. In many cases, the Designer will invoice the Client through Overnight Prints, in order to finish printing payments.

7. Copyrighted Material
Each Diaz Designs logo is original, but we make no guarantee regarding the legal availability of trade names or trademarks. The customer agrees to take sole legal responsibility should the logo design be infringing upon existing intellectual property, copyrighted material, trade names or trademarks of any kind.

8. Display Copyright
Diaz Designs retains the right to display all logo designs on its web site for promotional use only.

9. No Liability
Diaz Designs attests that all content does not contain any scandalous, libelous or unlawful material. This warranty does not extend to any uses that the Client may make of the product that may infringe on the rights of others. The Client agrees that it will not hold Diaz Designs liable for any misuse of content.

10. Confidentiality
Diaz Designs respects the sensitivity of business and marketing information and will treat these materials as private and confidential. Information in the public domain shall not, however, be considered confidential.

11. Acceptance of Terms
By using the design services of Diaz Designs, and signing up as a Client, you agree to be subject to our Terms and Conditions. Please read these terms carefully. These Terms and Conditions are subject to change without notice.
